The Federal Constitutional Court has declared the previous method of determining the value of real estate to be unconstitutional. This is because the standard values were set decades ago and the current values differ significantly from them. The property tax assessment amount depends on the property and its development or use (e.g., single-family home, rental property, or commercial property). This calculation has varied depending on the federal state (east or west), whether the property is new or old, and the size of the municipality. The assessment rate is set by the municipalities. As a result, the assessment rates vary even though the standard values are the same. Since January 1, 2022, all properties subject to taxation must be revalued.
Property tax is levied on real estate, as well as on hereditary building rights to domestic real estate and any buildings on it. Companies and institutions with extensive real estate holdings are also significantly affected by the property tax reform.
(For rented residential properties, it is part of the ancillary costs and can be passed on to tenants.)
For cities and municipalities, property tax is an important source of revenue used to finance the expansion and maintenance of public infrastructure such as schools, kindergartens, and road construction.
Who must submit a declaration of assessment?
Anyone who owns a property or condominium on January 1, 2022, must submit a declaration. In cases of hereditary building rights, the holder of the hereditary building right must submit the declaration.
How can the declaration of determination be made?
This must be submitted in digital form to the relevant tax office between July 1 and October 31, 2022. To do so, you will need a user account with ELSTER, the online portal of the tax authorities: www.elster.de

You will find the file number on your tax assessment notice. The land register extract contains all important information about your property. You can obtain this from the local court in your municipality.
