The property tax reform will come into effect on January 1, 2025. This does not mean that property owners can take their time. Action is already required, as the tax authorities require all necessary data for the revaluation of your property by the end of the third quarter: The submission deadline begins on July 1, 2022, and ends on October 31, 2022.

Reasons for the reform

The Federal Constitutional Court has declared the previous method of determining the value of real estate to be unconstitutional. This is because the standard values were set decades ago and the current values differ significantly from them. The property tax assessment amount depends on the property and its development or use (e.g., single-family home, rental property, or commercial property). This calculation has varied depending on the federal state (east or west), whether the property is new or old, and the size of the municipality. The assessment rate is set by the municipalities. As a result, the assessment rates vary even though the standard values are the same. Since January 1, 2022, all properties subject to taxation must be revalued.

Significance of property tax

Property tax is levied on real estate, as well as on hereditary building rights to domestic real estate and any buildings on it. Companies and institutions with extensive real estate holdings are also significantly affected by the property tax reform.

(For rented residential properties, it is part of the ancillary costs and can be passed on to tenants.)

For cities and municipalities, property tax is an important source of revenue used to finance the expansion and maintenance of public infrastructure such as schools, kindergartens, and road construction.

Who must submit a declaration of assessment?

Anyone who owns a property or condominium on January 1, 2022, must submit a declaration. In cases of hereditary building rights, the holder of the hereditary building right must submit the declaration.

How can the declaration of determination be made?

This must be submitted in digital form to the relevant tax office between July 1 and October 31, 2022. To do so, you will need a user account with ELSTER, the online portal of the tax authorities: www.elster.de

What data is requested?

  • File number
  • Location of the property: Street, house number, postal code, and city
  • Cadastral district(s) and parcel(s)
  • Property area
  • Standard land value
  • Type of property (e.g., undeveloped property or single-family home)
  • Year of construction (only after 1949)
  • Number of apartments and living space
  • Number of garage/underground parking spaces (if available)

Where can I find all the necessary information?

You will find the file number on your tax assessment notice. The land register extract contains all important information about your property. You can obtain this from the local court in your municipality.

Can't meet the deadline?

If you miss the deadline of October 31, 2022, you may face fines and an assessment by the tax office.

What types of land are there?

  • Undeveloped land
  • Residential property
  • Single-family house
  • Two-family house
  • Rental residential property
  • Condominium (e.g., owner-occupied condominium)

Does the property have multiple owners?

The information letters are sent to the owner listed first in the tax office's records. This person then informs any other co-owners about the letter.

What is the standard land value?

It describes the average location value of the land for a majority of comparable properties within a defined area. It is determined by the local expert committees

What is the effective date of the declaration of determination?

The declaration for determining the property tax value is made on the main assessment date. This is January 1, 2022.

When does the tax have to be paid under the new law?

Payments are due starting January 1, 2025. Once the process is done, you'll get a property tax bill.
