
Divorce property: when your new partner wants to move in
Katrin H. and Benjamin G. found themselves in exactly the same situation. Two years ago, Katrin H. divorced her husband Dirk H. While they were still separated, she decided to move in with her new boyfriend Benjamin G. into the property that belonged to her ex-husband and her. However, this met with considerable resistance from Dirk.
No emotionally charged conversations
Katrin tried to convince her angry ex-partner that she would continue to live in the shared house while he looked for a new apartment for the year of separation and beyond. But Dirk simply refused to listen. If it were up to him, he would rather sell the property than let his wife and her new boyfriend live there. The conflict escalated. The couple found themselves in a dilemma from which they could not escape on their own. A friend of the couple saw this too. To resolve the dilemma, she recommended that they seek the help of an impartial real estate professional to sort things out professionally.
Consultation with a real estate agent – possible solutions
Dirk and Katrin pulled together and made an appointment with a local real estate agent. The agent showed them various options for how to proceed in their situation. One option was for Dirk to sell his share to Katrin and use the money to find a new apartment.
The second option was for Dirk to move out without selling his share. In return, Dirk would be entitled to compensation for use of the property until the divorce was finalized. The real estate agent informed the couple that the amount of compensation would depend on several factors.
Among other things, it would depend on the value of the shared house. He recommended that the couple agree on an amount together, otherwise the family court would have to make a decision. As a further option, the real estate agent offered to sell the house professionally in order to divide the proceeds between the spouses. This would allow both partners to look for new and emotionally unburdened residential properties.
After the meeting, everyone sat down together and, with the help of the real estate agent, agreed on a solution that suited everyone. In the end, Katrin and Benjamin did not move into the old property, but were able to buy their own homes with the proceeds from the sale.
