
When will the virtual WEG meeting take place?
WEG law does not provide for virtual meetings
Property owners' meetings are often poorly attended. After all, many owners rent out their apartments and do not even live in the same city. And even for owner-occupiers, it is often difficult to fit the meeting into an already busy schedule. A virtual meeting, in which all participants can easily take part via video conference, would simplify many things. However, this is not provided for in the WEG Act of 1951. The law refers to "owners entitled to vote who are present," which is generally translated as "physically present."
Including virtual meetings in the community rules
However, it is up to the individual WEGs to decide whether owners can also appear virtually. To do this, the virtual meeting must be anchored in the community rules with the consent of all members. Otherwise, decisions made there will have little validity if an owner complains.
Experts advise that even in a virtual meeting, the most important criteria of a traditional owners' meeting should be met. This means that it must be freely accessible to every member of the WEG, not be public, and allow for a free exchange of opinions and proper freedom of decision-making.
Combining virtual and physical meetings
When comparing the various options for holding a virtual meeting, a video conference appears to be the best option. It ensures that it is clear who is participating and is not public, but only accessible by invitation. However, it is advisable to combine the video conference with a physical meeting. This is the only way to ensure that apartment owners who do not have the necessary technology can also participate in the conference.
If the traditional owners' meeting takes place in a room with an internet connection and a screen, all owners can decide for themselves how they prefer to participate. Digital solutions are also useful in other areas of WEG management. For example, scheduling is much easier when all owners can select the dates that suit them online. This means that nothing stands in the way of the next general meeting.
